                        2024年4月23日，欧洲议会投票通过《可持续产品生态设计法规》（Eco-design for Sustainable Products Regulation, ESPR）。ESPR规定了产品必须遵守生态设计要求才能进入欧盟市场流通或投入使用，其目的是提高产品的环境可持续性，并减少产品在其生命周期内的总体碳足迹和环境足迹。此外，ESPR还就产品数字护照、绿色公共采购和禁止销毁未售出的消费品等方面做出了具体要求。
                        值得企业注意的是，ESPR计划覆盖被投放到欧盟市场或投入使用的所有商品[1]，包括零部件和中间产品。在欧盟的第一个工作计划周期（2024-2027年）内，纺织品（特别是服装和鞋类）、家具等或将作为首批管控产品。
                        01 什么是生态设计，为何ESPR有此要求
                        在全球范围内，一半的温室气体排放和90%的生物多样性丧失是由初级原材料的开采和加工造成的[2]。传统经济发展的线性获取-制造-处置模式导致了资源的严重浪费，而产品设计决定了产品生命周期环境影响的80%，且生态设计在扩大规模时可以带来显著的成本节约[3]。因此，设计更可持续、循环和节能的产品是实现环境可持续和发展循环经济的基石，这也是ESPR诞生的原因。

                        ESPR定义的“生态设计”（eco-design）是指将环境可持续性因素融入产品设计及价值链流程中，不仅要关注产品的最终性能，还要关注产品生产、使用和废弃循环处理等全生命周期的各个环节对环境造成的影响。相较于关注产品特性和市场目标、将生产和消费造成的资源和环境问题滞留到末端治理的传统设计而言，生态设计是一种重要的减缓气候变化、促进循环再生、提升能效的预防措施，能打破“成本-质量-低碳可持续”不可能三角。“生态设计要求”（eco-design requirement）则是推动产品在设计过程中实现环境可持续的具体性能或信息标准。

                        从本质上来说，ESPR是对现行的生态设计指令（2009/125/EC）的修订。值得注意的是，相较2009/125/EC，ESPR在“生态设计”的定义中，增加了「价值链」的描述，并对价值链中不同角色（制造商、进口商、分销商、线上销售商、维修商等）提出了具体要求，如制造商应负责执行产品生态设计的合格评定程序，线上销售商应与市场监管机构合作打击不合规产品。
                        欧盟循环经济一揽子计划图
                        从原材料获取、生产制造、分销使用、到处置再利用，所有的产品都无法独立于价值链而存在。因此，价值链/供应链中任何一个环节的不合作都无法使产品真正可持续，价值链/供应链管理是发展循环经济、实现气候计划重要一环。在欧盟循环经济一揽子计划的法案中，、、等法规也都强调了价值链的重要性，并作出了相应要求。
                        02 哪些行业产品将受影响
                        现行的生态设计指令（2009/125/EC）主要针对能源相关产品，而ESPR将覆盖几乎所有欧盟市场产品[1]。ESPR生效后，2009/125/EC将被废除，但是部分要求将继续适用，如光伏板、热水器、空调、风扇、吸尘器、烹饪器具、计算机、服务器和数据存储产品等产品在2026年底前将继续遵循2009/125/EC，之后则须遵循ESPR。
                        此外，ESPR将根据产品在气候、环境、能源效率、经济市场贡献等方面的影响力，分批释放管控产品名单。在第一个工作计划内，欧盟委员会将优先考虑以下产品/产品组，纺织品（特别是服装和鞋类）、家具等产品将最先受到影响。汽车虽然不直接受ESPR管制，但其上游的钢铁、铝、轮胎等在覆盖范围内。
                        除了产品名单的逐步释放外，ESPR还将逐步扩展对横向措施的要求，横向措施可以理解为ESPR对产品性能或参数要求，比如与环境影响有关的碳足迹、与耐用性有关的可修复性评分指数。
                        有哪些横向措施值得企业提前布局？如下图所示，除了传统的体积、重量、噪声、能源消耗等基础参数外，产品的碳足迹和环境足迹等环境影响、耐用性、可回收性等将被重点关注。
                        03 产品数字护照，数字化是促进循环可持续发展的重要工具
                        溯源对于循环可持续来说至关重要，如果没有追溯系统，就没办法确保产品真正环保、低碳、循环。简单高效的溯源工具不仅有助于价值链上的企业获取必要信息，还可以通过透明化的信息披露使消费者更了解产品的可持续性能，如产品碳足迹数据的披露可以帮助消费者选择更低碳的产品，潜移默化培养消费者的绿色消费习惯。
                        在此背景下，能以数字化形式记载充分产品关键信息的“数字护照”应运而生，使产品能够被标记、识别并链接到与其循环性和可持续性相关的数据。价值链上的企业和消费者可以通过访问“数字护照”（通常以二维码、在线标签链接、网址等为信息传递载体）快速溯源产品信息，并据此做出采购或消费判断。如下图所示，消费者可以通过扫描二维码溯源产品（宠物衣服）的碳信息。
                        欧盟在数字化溯源方面的布局已经十分明晰。《可持续及循环纺织品战略》要求纺织品提供数字护照，披露充分的可持续信息供消费者参考选择，如成分、材料、碳足迹等。《新电池法》要求从2027年起，动力电池出口到欧洲必须持有符合要求的“电池护照”，记录电池制造商、材料成分、碳足迹、供应链等信息。ESPR认为产品数字护照是向价值链参与者提供信息的重要工具，可以增强产品在整个价值链中端到端的可追溯性。因此，ESPR要求产品数字护照做到用户友好，数据准确、完整和最新。
                        04 结语
                        ESPR通过建立可持续产品生态设计要求的框架，促进循环经济发展，增强全球价值链的可持续性和弹性，从长远来看，有助于倒逼技术进步和绿色转型。然而，对于我国的制造商和出口商来说，如何确保其出口的产品满足ESPR并成功进入欧洲市场，将是新的挑战。
                        值得一提的是，ESPR还将利用强制性绿色公共采购要求，刺激企业供应性能更佳、循环水平更高、更低碳的生态设计产品。我国的绿色采购政策也正在逐步完善，绿色低碳可持续产品将更受公共采购青睐。
